Exbusa Limited - Service
It is Exbusa's mission to deliver the finest possible range of products and customer service at all times, we therefore adhere to and if possible exceed all of the current and proposed legislation and trade body guidelines.
1. Products will be the responsibility of the customer from the time of delivery.
2. Any defective product(s) purchased from the Website must be returned to us within thirty (30) days of receipt. In the event that the relevant defect is found to have been caused by us (as determined in our absolute discretion) we shall, in our sole discretion, either supply replacement product(s) free of charge; or reimburse the price paid for the relevant product(s) to the credit or debit card used to purchase the goods
3. For the avoidance of doubt, we cannot be held responsible for Products which are damaged in transit
4. All complaints relating to Products purchased from the Website should be made in writing within thirty (3) days of receipt to Exbusa Limited, Unit 9, 70 Strathclyde Street, Glasgow, G40 4JR. We will endeavour to resolve any complaint within fourteen (14) days or receipt of a complaint letter but shall have no obligation so to do.
5. We are unable to offer refunds on any personalised Products due to the personalisation element of the Product.
6. Please ensure that your personalisation options are correct at the time of ordering as we cannot be held responsible for common errors such as misspellings or punctuation errors.
7. Special characters and symbols risk not be printed on your final order as the production machinery used may not be able to replicate these special characters. If you use special characters we cannot be held responsible for the characters not being printed on your item.

No order is binding upon Chocmotif until accepted by us.
Chocmotif will make all reasonable efforts to supply the goods ordered by the customer (whether to the customer directly or to the recipient requested by the customer) within the delivery time indicated at the time of order.
The customer is responsible for ensuring that any goods ordered are suitable for the customer’s purposes and meet the customer’s requirements. As the goods are tailored to the specific requirements of the customer, no cancellation or changes may be requested or refunds can be made once the order has been placed
Product and packaging are subject to change or substitution without prior notice.
For bespoke goods, a pro-forma invoice will be issued on receipt of order which will give a date by which payment must be received. This date will be prior to the production of your order. Payment in full must be made by this date to ensure your order is processed. Where credit terms are offered or agreed, interest will run from the date of invoice at the rate of 2.5% per month on all outstanding balances. All goods supplied, will remain the property of Exbusa Limited until paid for in full. Payment can be made by cheque, payable to Exbusa Limited, by WorldPay (credit/debit card) Paypal or directly to our bank account.
The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling that you will pay. If you are ordering from outside the United Kingdom the appropriate exchange rate will apply.
Exbusa Limited warrants to the customer that the goods supplied will comply substantially with the description given by Exbisa Limited and will be satisfactory quality.
This warranty represents Exbusa’s entire warranty to the customer and to any recipient of the goods to the exclusion of all other warranties to the maximum extent permitted by law.
The customer’s sole remedy for breach of this warranty shall be (at Exbusa's sole option) replacement of the goods or refund of any price paid by the customer in respect of the goods and Esbusa Limitedshall incur no further liability (direct or indirect) in respect of the supply of the goods.
Chocmotif Images and Text
It is important that the customer obtains the permission of the owner of the copyright (and any other intellectual property rights anywhere in the world) for any wording or images before submitting them to Chocmotif. By submitting wording or images the customer is permitting Chocmotif to use them in relation to the customer’s order.
Chocmotif reserves the right to refuse to use any wording or images supplied by a customer where, in Chocmotif’s opinion, to do so would be illegal, immoral, in poor taste or would infringe the intellectual property rights of any person in any part of the world.
Where Chocmotif does use any wording or images provided by the customer then this shall be at the customer’s own risk. Chocmotif shall not be responsible for any loss, claim, cost or damage incurred by the customer (or any recipient of the goods) as a result of the inclusion of any wording or image on the goods at the request of the customer. In addition, the customer will indemnify Chocmotif against all and any loss, claim or damage incurred by Chocmotif as a result of any wording or image on the goods at the request of the customer.
Colour Variations and Print Quality
Customers should be aware that Chocmotif is unable to colour match any image submitted to them, images should be high resolution, ‘greyscaled’ and be jpegs. The printing process is carried out using edible food dyes, and, whilst photographic definition is possible accurate reproduction is limited to what can be achieved using this process.
Chocmotif will output images and text at 80 dpi regardless of the resolution of any image submitted by the customer. Customers should be particularly aware that most images obtainable from the internet are of low resolution and whilst these images will appear to be of high quality when viewed on a computer screen, these images are not suited to reproduction at larger scale and in higher resolution.
All Website design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on this Web site are copyright Chocmotif and is affiliates, or their content and technology providers. Trademarks and Patents
Chocmotif is a Registered Trademark and the process by which Chocmotif cards are manufactured is covered by UK Patents. Our packaging is covered by a variety of OHIM Registered Community Designs.
Chocmotif shall not be liable to the customer or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any of Chocmotif’s obligations in relation the goods, where the delay or failure was due to any cause beyond Chocmotif’s reasonable control and without prejudice to the generality of the foregoing the following shall be regarded (without limitation) as causes beyond Chocmotifs reasonable control: acts of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; Acts, restrictions, regulation, bye-laws or measures of any kind on the part of any governmental parliamentary or local authority; import or export regulations or embargoes; strikes; lockouts or other industrial actions or trade disputes (whether involving employees of Chocmotifs or of a third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; and power failure or breakdown in machinery.
These Terms and Conditions and any legal relationship between the Customer and/or the recipient of the goods and Chocmotif shall be governed by the law Scotland and submitted to the exclusive jurisdiction of the Scottish Courts, but without prejudice to the right of Chocmotif to seek recovery of any sums due to it before any court of competent jurisdiction.
